போபாலும் ஆங்கில காந்திமதிகளும்!

கடந்த சில நாட்களாக, போபால் விஷவாயு விபத்தின் குற்ற வழக்கு தீர்ப்பு குறித்து நமது ஆங்கில தொலைக்காட்சி ஊடகங்கள் நடந்து கொள்ளும் முறை எரிச்சல் ஏற்ப்படுத்துவதாய் உள்ளது.

வழக்கின் தன்மை பற்றியோ, குற்றவியல் நடைமுறை பற்றியோ சிறிதும் சிந்திக்காமல் ‘நீதி செத்து விட்டதுஎன்றும் வாரன் ஆண்டர்சன் தப்பித்து விட்டார் என்றும் கூக்குரலிடுவதில் ஏறக்குறைய நமது தமிழ்ப்படங்களில் காந்திமதி மண்ணை வாரி தூற்றி சாபம் விடும் இயலாமைதான் தெரிகிறது.

தற்பொழுது தண்டனை பெற்றவர்களின் மீதான குற்றச்சாட்டு கவனக்குறைவான செயலால் மரணம் ஏற்ப்படுத்தியது. அந்த குற்றத்திற்கு அதிகபட்ச தண்டனை இரண்டு ஆண்டுகள்தான். அதையும் கொடுத்தாயிற்று. பின்னர் எங்கிருந்து நீதி செத்தது என்பது தெரியவில்லை.

வேறு கடுமையான குற்றச்சாட்டு ஏற்கனவே நீக்கப்பட்டு கவனக்குறைவினால் மரணம் ஏற்ப்படுத்துதல் என்ற வகையிலே மட்டும் குற்றம்சாட்டப்பட்டுள்ளது கடந்த பல ஆண்டுகளாக அனைவருக்கும் தெரிந்த நிலையில், அதைப் பற்றி சிறிதும் கவலைப்படாத ஊடகங்கள் தற்பொழுது ஏன் இப்படி அலறுகின்றன என்பது புரியவில்லை. (எனது போபால் பற்றிய கட்டுரையில் இதனைப் பற்றி குறிப்பிட்டுள்ளேன்)

ஆண்டர்சன், தேடப்படும் குற்றவாளியாக அறிவிக்கப்பட்ட பின்னர், அவரைப் தனியே பிரித்து மற்றவர்களைப் பற்றி மட்டும் வழக்கு நடைபெற்ற சூழலில், தீர்ப்பில் ஆண்டர்சனைப பற்றி குறிப்பிடவில்லை என்று தனியே ஒரு புலம்பல்!


காங்கிரஸ் என்ன செய்தது, பிஜேபி என்ன செய்தது என்று தற்பொழுது கேட்கும் ஊடகங்கள், இது வரை தாங்கள் என்ன செய்தோம் என்பதையும் கூறினால் நல்லது. இதில் வேடிக்கை என்னவென்றால், டைம்ஸ் நவ் ‘இதோ நாங்கள் ஆண்டர்சனின் இருப்பிடத்தைக் கண்டுபிடித்து விட்டோம்என்று ஒரு தம்பட்டம். விட்டால், காப்டன் பிரபாகரன் போல அவரை சங்கிலியில் கட்டி அட்லாண்டிக் வழியே கூட்டி வந்து விடுவார்கள் போல.

ஆண்டர்சன் எங்கு வசிக்கிறார் என்பது, எந்தக் காலத்திலும் யாருக்கும் தெரியாத ரகசியமல்ல. பல வருடங்களுக்கு முன்னரே அவர் வசிக்கும் வீட்டின் படங்கள் பத்திரிக்கைகளில் வெளியானது.

ஆண்டர்சன் அரச மரியாதையுடன் இந்தியாவை விட்டு சென்றது அன்றே தொலைக்காட்சியாலும் பத்திரிக்கைகளாலும் ஆவணமாக்கப்பட்ட ஒரு விடயம். இவ்வளவு வருடங்கள், அதைப் பற்றி எதுவும் கவலைப்படாத இந்த ஊடகங்கள், தற்பொழுது அர்ஜுன் சிங் தாத்தாவைப் போட்டு இப்படி காய்ச்சுவது என்ன நியாயம் என்று புரியவில்லை.

தர்ம அடி என்பது இதுதான். யார் வேண்டுமானாலும் ஒரு தடியை எடுத்து அர்ஜுன் சிங்கை ஒரு போடு போட்டு விட்டுப் போகலாம் போல. ஆண்டர்சனை இங்கிருந்து அனுப்ப வேண்டுமென்றால், ஒரே ஒரு மனிதர்தான் அதற்கு உத்தரவிட்டு இருக்க முடியும். அவரை குறிப்பிட முடியாது. அர்ஜுன் சிங் என்றால் பிரச்னை இல்லை!

‘குற்ற மனமில்லாச் செயல் குற்றமல்லஎன்பது குற்றவியலின் முக்கியமான ஒரு விதி. எந்த ஒரு தவறான செயலையும் தண்டனைக்கேதுவான குற்றச்செயலாக கருதுவதற்கு ‘mens reaஎனப்படும் குற்றமனம் தேவை.

கவனக்குறைவான் ஒரு செயலால் மற்றொரு நபருக்கு ம்ரணத்தையோ அல்லது காயத்தையோ விளைவித்தல் இந்திய தண்டனைச் சட்டத்தின் கீழ் குற்றம். கவனக்குறைவான ஒரு செயலில், மேற்கண்ட குற்ற மனம் இல்லை என்பது போலத் தோன்றினாலும் அந்த வகையில் கவனக்குறைவாக இருத்தலுக்கு ஒரு குற்ற மனம் தேவை.


எனினும், இந்த வகை குற்றத்திற்காக சட்டம் அளிக்கும் தண்டனை மிகக் குறைவு. அதிக பட்சம் இரண்டு வருடங்கள்!

இந்திய தண்டனைச் சட்டம் இயற்றப்பட்ட பொழுது பெரிய வாகனங்களும் இல்லை. நச்சு தொழிற்சாலைகளும் இல்லை. எனவே கவனக்குறைவாக வாகனத்தை ஓட்டியோ அல்லது நச்சுப்புகை தொழிற்சாலை நடத்தியோ ஒருவரை கொன்றாலும் சரி, ஆயிரம் பேரை கொன்றாலும் சரி அதே சிறிய தண்டனைதான்.

போபால் விபத்திலும் சரி, தொடர்ச்சியாக காரை ஏற்றி பல பேரை கொன்று போட்ட சல்மான்கான், நந்தா வழக்குகளிலும் இந்த தண்டனை போதாது என்று கொலை இல்லை என்றாலும் தண்டிக்கத்தகுந்த வகையில் மரணத்தை ஏற்ப்படுத்துதல் ( Culpable homicide not amounting to murder) என்ற் அதிகபட்சம் பத்து வருடம் தண்டனை தரத்தக்க ஒரு குற்றச்சாட்டு வைக்கப்பட்டது. எதிர்ப்பார்த்தது போல, போபால் வழக்கிலும், அந்த குற்றச்சாட்டு உச்ச நீதிமன்றத்தால் நீக்கப்பட்டது.

எனவே, போபால் தீர்ப்பில் அதிர்ச்சி தெரிவிக்க புதிதாக என்ன இருக்கிறது என்று புரியவில்லை!

குற்ற வழக்கை விடுங்கள். உண்மையில் நாம் கோட்டை விட்டது நஷ்ட ஈடு வழ்க்கில்.(எப்படி என்ற விபரம் எனது போபால் கட்டுரையில் உள்ளது) எனெனில் தொழிலதிபர்கள் தூக்கு மேடைக்கு கூட போவார்கள். ஆனால் தாங்கள் திவாலாவதை பொறுத்துக் கொள்ள மாட்டார்கள். பாதிக்கப்பட்டவர்களுக்கும் தவறிழைத்தவர்களின் இரத்தத்தினை விட, வளமான எதிர்காலத்திற்கான தகுந்த பாதுகாப்பே சிறந்த நிவாரணமாக இருக்க இயலும்.

தொழில் நடத்த வேண்டும் என்றால், அந்த தொழிலுக்கு சம்பந்தமே இல்லாத ஏழைகள் அதனால் பாதிக்கப்பட்டால் அதற்கான முழு நஷ்ட ஈடும் அளிக்க தொழில் நிறுவனங்கள் தயாராக இருக்க வேண்டும்.


அந்த வகையில், இப்படி உணர்ச்சிகரமாக பிரச்னையை கிளப்பியதற்கு வேண்டுமானால் ஆங்கில தொலைக்காட்சி ஊடகங்களிற்கு நமது நன்றியினை தெரிவிக்கலாம்!

ஆங்கில சீரியல் - Yes Ministerல் ஒரு வசனம் வரும். Under developed நாடுகள் என்று சொல்வதற்கு பதில் Human resource rich countries என்று சொல்கிறோம் என்பார். அதற்கு அர்த்தம் - they are grossly over-populated and begging for money.

போபால் விசயத்தை தற்போது அமெரிக்காவில் நடக்கும் பிபி எண்ணெய்க்கிணறு பிரச்சனையுடன் ஒப்பிடலாம்.

அமெரிக்காவில் இப்படிப் பிரச்சனைகளின் போது அதிபர் மற்றும் சபை (செனட் மற்றும் காங்கிரஸ்) உறுப்பினர்கள் நேரடியாக இந்தக் கம்பெனியின் அதிபர்களை சபைக்கே அழைத்து வந்து கேள்வி கேட்கிறார்கள்.

டொயாட்டா கார் பிரச்சனை மற்றும் பேங்க் பிரச்சனையில் இதுவே நடந்தது.

இன்று அதிபர் பிபி எண்ணெய்க்கிணறு முதலாளிகளிடம் நேரடியாகப் பேசுகிறார். இந்தியாவில் முதுகெலும்பற்ற அரசியல்வாதிகள் எல்லாவற்றையும் நீதி மன்றத்திற்கு தள்ளிவிட்டு தப்பித்துவிடுகிறார்கள். நீதி மன்றம் அரதப்பழசான 500 ரூபாய் அபதாரம் அல்லது 2 வருட தண்டனை போட்டுவிடுகிறது.

சட்டங்கள் சரியில்லை. சட்டத்தின் அடிப்படையில் தீர்ப்புச் சொல்லுபவர்களை குற்றம் சொல்ல முடியாது.

Prabhu Uncle - As always, I enjoyed this provocative, yet, humorous posting. According to you, justice was meted out to the victims of Bhopal Gas Tragedy. I am afraid I have to disagree. I am not a lawyer and so my intent is to offer a valid riposte, so that I can learn more from your response. So, please do explain if my train of thought holds good.

You treat this entire episode as one of "negligence" for which a maximum punishment of 2 years was awarded. But then, at the behest of the Central Bureau of Investigation, it was the Indian court, that reduced the charge from one that of "culpable homicide" to "criminal negligence." Here, the Legislature (Parliament), Executive (CBI), and Judiciary (Courts) royally screwed the victims. And the Press, by being a mute spectator, as you yourself have opined, shirked its duty as well. Ipso facto, for a neutral person like me -- who is not part of any of the 4 (mute) pillars of democracy or even a lawyer -- I feel, justice was not meted out.

Now, coming to your fundamental argument, you are absolutely right in trying to ascertain if there was ever mens rea in Union Carbide gassifying the victims inadvertently. Well, from that fact alone, there may be a lack of mens rea, but modern jurisprudence is definitely trudging along the lines of ascertaining whether the company or corporation willfully and knowingly violate or bypass regulatory standards to cause this disaster?

Now, India's Tort law standards are not similar to the US model, but falls in line more with the British model. Once again here, India did take a positive step of embracing Absolute Liability as the legal basis instead of Strict Liability that is somewhat less effective from victims' standpoint, which is what the British jurisprudence supports!

However, in both the cases, I don't think there is any requirement for mens rea to be a prima facie requirement. Am I wrong?

Here is my logic: Several years ago, when I was researching out of sheer academic interest, I came across two legal paradigms as applicable in criminal cases: malum in se (evil in and by itself) versus malum prohibitum (evil because of violation of statutes and regulations). Now, when you apply the yardstick of even strict liability, it comes closer to infractions or violations that are malum prohibitum, for which it suffices to show that the defendant (in this case Union Carbide) violated regulations. Period. Here no "good faith" (bona fide) or "I took all possible precautions" excuse from Union Carbide would cut ice. Right?

Now, if you were to apply the absolute liability yardstick, it doesn't require any mens rea (criminal intent or motive), but all it requires is an actus reus (guilty act). Right?

So, either way, you want to look at it, there are enough grounds to prosecute.

Now, if one were to argue, that Union Carbide did follow the regulations as set by the Indian Government, I will argue that we are in the time and era of "Universal Jurisdiction". Where there was gross impropriety and wider deviation in industrial norms between International and Indian standards, a prima facie case can be made against Union Carbide for the purposeful violation of standards. Not only was it a MNC at the time of offense, but Indian Courts liberally and usually apply jurisprudence of US and European Courts and so to "infer" mens rea by holding them to a higher international industry standard should only be fair and logical. There you get your mens rea as well. Won't you?

I am sorry to say, but India is becoming a "Dollar Colony" as the eminent Jurist Justice (Retd) Mr. VR Krishna Iyer eloquently puts it. I am afraid I need to quote him more eloquently here: "This is Macaulay's justice of Victorian vintage still ruling India. Our Parliament and the Executive are less concerned with the lives of ‘We, the People of India'; their deprivation is of little consequence. The judiciary is another paradigm of insouciance and it is often indifferent to its fundamental duty of issuing a swift verdict. Parliament is too busy making noises to be able to make laws to defend citizens' lives. The investigative-judicial delay that has occurred is unpardonable for a crime of this kind."

For this and many other reasons, I really can't agree to the argument that justice was served as per the books and laws of the Zeitgeist.

நான் சொல்ல நினைத்தது IPC பற்றி அல்ல. தொழிற்சாலையை பாதுகாப்பாக நடத்த இருக்கும் நடைமுறைகள், கட்டுபாட்டு வாரியங்கள், அதிகார மையங்கள், ஏனைய ஆணையங்கள் எல்லாம்தான். அவைகள் வளைந்து கொடுக்காமல் முனைப்பாக இருந்திருந்தால்... இம்மாதிரியான விபத்துகளையே பெருமளவில் தடுத்திருக்கலாம் என்ற ஆதங்கத்தையே பகிர்ந்து கொள்ள நினைத்தேன்.
