கட்ஜூவின் என்கவுண்டர்!

உச்ச நீதிமன்ற நீதிபதி மார்கண்டேய கட்ஜூ நமது உயர்நீதிமன்றத்தில் தலைமை நீதிபதியாக இருந்த பொழுது, எனது மூத்த வழக்குரைஞர், ’அவரது தீர்ப்புகள் செல்லுமா?’ என்று ஒரு சந்தேகத்தை எழுப்பினார். ‘ஏன் சார்?’ என்றால்…

‘அவர்தான் பதினாறு வயசை தாண்டவில்லையே. மைனர் சொன்ன தீர்ப்பு செல்லுமா?’ என்றாரே பார்க்கலாம்.

18 வயதுக்குள் செய்யப்படும் செயல்கள் குற்றமாகாது என்ற தைரியத்தில்தான், கட்ஜூ அவர்கள் அலகபாத் நீதிமன்றத்தை அவமதிக்க துணிந்துள்ளார் போல!

மூன்று நாட்களுக்கு முன்னர் தான் கூறிய தீர்ப்பு ஒன்றில், அலகபாத் உயர்நீதிமன்ற தனி நீதிபதி கூறிய தீர்ப்பு சட்டம் சாராத ‘வேறு பலன்களுக்காக’ கூறப்பட்டுள்ளதாக தனது தீர்ப்பில் குற்றம்சாட்டியுள்ளார் (as these interim orders are clearly passed on extraneous consideration).

ஒரு தீர்ப்பினைப் பற்றி சட்டரீதியில் விமர்சிக்கலாம். சட்டம் சாரத வகையில் கூட குறை கூறலாம். ஆனால் அந்த தீர்ப்பினை நீதிபதி வேறு பலன்களுக்காக கூறியுள்ளார் என்று கூறுவது நீதிமன்ற அவமதிப்பாகும். இந்த அடிப்படையில் கட்ஜூ கூறியவை, ஒரு தீர்ப்பில் கூறப்பட்டிருப்பினும், நீதிமன்ற அவமதிப்பே!

தனி நீதிபதியில் உத்தரவு சட்டப்படி சரியான ஒரு உத்தரவா இல்லையா என்ற மேல் முறையீட்டில், தீர்ப்பினை பற்றி எவ்விதமான விமர்சனத்தையும் கூற கட்ஜுவிற்கு உரிமை உண்டு. ஆனால், உத்தரவு வேறு பலன்களுக்காக கூறப்பட்டுள்ளதாக கூறியது, நீதித்துறையின் அனைத்து நெறிமுறைகளையும் மீறிய ஒரு செயல்.

ஒரு நீதிபதி, அதுவும் பாராளுமன்ற ஒட்டெடுப்பு முறை மூலமே பதவி நீக்கம் செய்யப்படத்தக்க ஒரு உயர்நீதிமன்ற நீதிபதி வேறு பலன்களுக்காக தீர்ப்பு கூறுவது என்பது, பதவி நீக்கம் செய்யப்பட வேண்டிய அளவுக்கு முறை தவறிய செயல். மட்டுமல்லாமல் அந்த நீதிபதியை சிறையில் அடைக்க வேண்டிய குற்றச் செயல். ஆனால், கட்ஜு, நீதிமன்ற நடைமுறை, இயற்கை நீதி போன்றவை இந்த நாட்டின் நீதிதுறையின் ஆதர்ச விதிகள் என்பதையெல்லாம் மறந்து, மிகச் சாதாரணமாக ஒருவரை குற்றவாளி என்று கூறியுள்ளார். இந்திய அரசியலமைப்பில் தான் வகிக்கும் மிக உயர்ந்த ஒரு பொறுப்பின் முக்கியத்துவத்தையும் தனது தீர்ப்பில் எழுதும் ஒவ்வொரு வார்த்தையும், 100 கோடி மக்கள் தொகையுள்ள இந்த நாட்டின் அனைத்து நீதிமன்றங்களையும் கட்டுப்படுத்தும் என்பது புரியாமல் செயல்பட்டுள்ளார்.

இந்த நீதித்துறை தாக்குதலின் ‘Judicial Encounter’ அதிர்ச்சியிலிருந்து யாரும் மீளவில்லை போல. மூன்று நாட்களாகி விட்டன. இனிதான் பார்க்க வேண்டும். உச்ச நீதிமன்றம் என்ன செய்யப் போகிறது என்பதை!

இவ்வாறு அதிர்ச்சி வைத்தியம் கொடுப்பது, கட்ஜுவுக்கு ஒன்றும் புதிதல்ல. தனது அளவுக்கு மீறிய ஆர்வத்தால் இப்படித்தான் வார்த்தைகளை கொட்டி, பின் மாட்டிக் கொள்வார்.

கடந்த மாதம்தான், திருமணம் இல்லாமலேயே இருவர் சேர்ந்து வாழும் முறை பற்றிய தீர்ப்பில், வைப்பு (keep) என்ற வார்த்தையினை பயன்படுத்தி வழக்குரைஞர் இந்திரா ஜெய்சிங்கிடம் வாங்கி கட்டினார். (If a man has a `keep' whom he 1maintains financially and uses mainly for sexual purpose and/or as a servant it would not, in our opinion, be a relationship in the nature of marriage)

இங்கே ஒன்றைக் குறிப்பிட்டாக வேண்டும். கட்ஜு எப்படி அப்பழுக்கில்லாத நேர்மையானவரோ அதே போன்று, பெண்களிடம் பரிவு மிக்கவர்.

நிர்வாகம் அதன் வேலையை செய்யட்டும். நீதிமன்றங்கள் அதனுடைய வேலையை மட்டும் செய்யட்டும்’ என்பதில் கட்ஜு அசைக்க முடியாத நம்பிக்கை உள்ளவர். நிர்வாகத்திலோ அல்லது சட்டமியற்றுதலிலோ நீதிமன்றங்கள் தலையிடுவதைக் கண்டால் அவருக்கு பொறுக்காது.

அந்த வேகத்தில், நுகர்வோர் நீதிமன்றங்கள் தேவையான அளவிற்கு உருவாக்கப்பட வேண்டும் என்று வலியுறுத்திய உயர்நீதிமன்ற தீர்ப்பினை தள்ளுபடி செய்கையில், உயர்நீதிமன்றத்தோடு நிற்காமல், இடைக்கால உத்தரவு வழங்கிய உச்ச நீதிமன்ற நீதிபதிகளையும் தனது தீர்ப்பில் ஒரு கை பார்த்தார். கூட இருந்த நீதிபதி பயந்து போய் தனியே தீர்ப்பு எழுதி, அதோடு நிற்காமல், ‘For the views been taken herein, I regret to express my inability to agree with Brother Katju, J. in regard to the criticisms of various orders passed in this case itself by other Benches. I am of the opinion that it is wholly inappropriate to do so. One Bench of this Court, it is trite, does not sit in appeal over the other Bench particularly when it is a coordinate Bench. It is equally inappropriate for us to express total disagreement in the same matter as also in similar matters with the directions and observations made by the larger Bench. Doctrine of judicial restraint, in my opinion, applies even in this realm. We should not forget other doctrines which are equally developed viz., Judicial Discipline and Respect for the Brother Judges’ State of UP Vs. Jeet Bisht 2007 (6) SCC 586’ என்று அதே தீர்ப்பில் கட்ஜுவையும் விமர்சிக்க வேண்டியதாயிற்று.

ஆயினும், மேற்கண்ட தீர்ப்பு வெளிவந்த சில நாட்களில், பல்வேறு குற்றச் செயல்களுக்காக குற்றம் சுமத்தப்பட்ட பெண்கள், சிறுவர்கள் ஆகியோருக்கு மறுவாழ்வு கொடுப்பது சம்பந்தமாக உச்ச நீதிமன்றத்தில் தாக்கல் செய்யப்பட்ட ஒரு பொதுநல வழக்கினை வேறு இரு நீதிபதிகள் ஏற்க மறுத்து, அவ்வகையான வழக்குகளை நீதிமன்றம் விசாரிக்கலாமா என்ற கேள்விக்கு பதிலளிக்க மூன்று நீதிபதிகள் அடங்கிய மன்றத்தை அமைக்க வேண்டும் என்று கேட்டுக் கொண்டனர். இந்தப் பிரச்னை பெரிதாக கிளம்ப தலைமை நீதிபதி பாலகிருஷ்ணன், ‘பொதுநல வழக்குகள் தாக்கல் செய்ய தடை இல்லை’ என்று அறிவிக்க வேண்டியதாயிற்று.

ஆயினும் கட்ஜுவை ஒரு பிடி பிடிக்க வேண்டும் என்று காத்திருந்தவர்களுக்கு, அடுத்த வருடமே ஒரு சந்தர்ப்பம் கிடைத்தது.

அரசு மற்றும் அரசு சார்ந்த துறைகளில் தற்காலிக பணியாளர்களாக வேலைக்கு சேர்பவர்களை பின்னர் நிரந்தரமாக்குதல் கூடாது என்று முன்பு உச்ச நீதிமன்றத்தின் ஐந்து நீதிபதிகள் அடங்கிய பெஞ்சு உமா தேவி (JT 2006 (4) SC 420) என்ற வழக்கில் ஒரு தீர்ப்பு கூறியிருந்தது.

ஆனால், பின்னர் கட்ஜுவும் மற்றொரு நீதிபதியும் இருக்கும் இரு நீதிபதிகள் அடங்கிய பெஞ்சு முன்பு பணி நிரந்தரம் சம்பந்தப்பட்ட மற்றொரு வழக்கு வர கட்ஜு பணி நிரந்தரம் செய்யலாம் என்பதோடு நிற்காமல், உமா தேவியின் வழக்கு யூக்லிட்டின் தேற்றம் போல அப்படியே கடைபிடிக்க வேண்டியதில்லை’ என்றும் கூறினார் (we find that often Uma Devi's case (supra) is being applied by Courts mechanically as if it were a Euclid's formula without seeing the facts of a particular case. பூரன் சந்திர பாண்டே வழக்கு 2007 (11) SCC 92)

ஒரே வருடத்தில் மற்றொரு நிரந்தரமாக்குதல் பிரச்னை உச்ச நீதிமன்றத்தின் மூன்று நீதிபதிகள் அடங்கிய பெஞ்சுக்கு முன்பு வந்த பொழுது (தயானந் வழக்கு 2008 (10) SCC 1) பூரன் சந்திர பாண்டே வழக்கில் கட்ஜூவின் தீர்ப்பினை வெறுமே ஒரு கருத்தாக எடுத்துக் கொள்ள வேண்டுமே தவிர, மற்ற உயர்நீதிமன்றங்களை கட்டுப்படுத்தும் ஒரு முன்தீர்ப்பாக எடுத்துக் கொள்ளக் கூடாது என்று தீர்ப்பு கூறப்பட்டது (In the light of what has been stated above, we deem it proper to clarify that the comments and observations made by the two-Judges Bench in UP State Electricity Board vs. Pooran Chandra Pandey (supra) should be read as obiter and the same should neither be treated as binding by the High Courts, Tribunals and other judicial foras nor thwe find that often Uma Devi's case (supra) is being applied by Courts mechanically as if it were a Euclid's formula without seeing the facts of a particular case)

முக்கியமாக இந்த தீர்ப்பில் நீதிபதிகள், மற்ற உயர்நீதிமன்றங்களுக்கு கூறுவது போல கட்ஜுவிற்கு ‘நீதித்துறையின் மாண்பினை’ போற்றுவது குறித்து கடுமையான வார்த்தைகளில் அறிவுறுத்தியிருந்தனர்.

வேடிக்கையான அம்சம் என்னவென்றால், நீதித்துறையின் ஒழுக்கத்தை பேண வேண்டியது குறித்து அறிவுறுத்த மூன்று நீதிபதிகள் பயன்படுத்திய வரிகள், ஜீட் பிஸ்ட் வழக்கில் கட்ஜு கூறிய தீர்ப்பிலுள்ள வரிகள்!

இந்த முறை கட்ஜு சற்று அகல கால் வைத்துள்ளார்...யார் காலை தட்டி விடப்போகிறார்கள் என்று பார்க்கலாம்.

Recently, former Law Minister Shanthi Bhushan filed an affidavit before the Honorable Supreme Court of India showing that former 8 Chief Justices were definitely corrupt. As Mr. Bhushan goes on the record, "The real problem is that there are hardly any crusaders in the judiciary. Even honest judges try to defend the corrupt ones because they feel it’s one judicial family."

That is the crux of the issue. And in a country like India, where criticizing the Bench or the Judges can result in contempt of court, Senior Counsel at Supreme Court of India, Rajeev Dhawan wondered why the Tehelka magazine and advocate Prashant Bhushan should be hauled up for contempt when the Supreme Court itself was making such comments.

If anything, I salute the incisive strictures and serious indictment from Honorable Katju's judgment on the Allahabad High Court. Just the previous day, he lashed out at the Madras High Court, pulling-up the Commissioner of Chennai Corporation as well.

In other words, he is not a tepid Judge, but an active one interested in cleansing the Augean stables of the corruption in higher levels of Indian Judiciary.

So, what the Division Bench noted in its judgment was a mere reflection of what it is currently, for the lack of anything better (faute de mieux). As Ms. Jaising averred, we are seeing men started to being "kept" in "modern" India as well. So, in future this word may connote either sex. But until then, accusing Justices Katju and TS Thakur as though they were chauvinists was nothing but an attempt to gain cheap publicity. But for this needless controversy, the judgment on this "keep" case was extremely well thought-out. Even when TS Thakur asked if "concubine" would be a better replacement to douse Jaising's anger, she lashed out at him even more for that suggestion. My question is: if Jaising is so peeved, why can't she offer suggestions? The Justices were hardly trying to use the words that exist in the Indian language as could be understood by the common-man. Sure, "keep" could mean men in future too as we are reading about "male prostitutes" becoming common in upper-middle-class and rich-societies in major metros like Chennai, Mumbai, and Bangalore, and so this word would naturally undergo a change in future. I personally feel that the Justices should have been treated more charitably on this judgment by Jaising and her ilk. At least, some kind of rapprochement to find a suitable alternative should have been attempted. Instead, attempts to throw the baby with the bathwater is in poor taste. Oh well, c'est la vie.

Justice Markandey Katju is known for his uprightness, straight-forwardness, incisive and pointblank judgments, besides wonderful quotes and synthesis of legal arguments for the uplift of the Indian society in general.

He is a hero to people like me :-)
